Terms of Use

Important: CyberAtlas is a directory and listing platform only. We are not a cybersecurity service provider and we are not a party to any agreement, engagement, or transaction between you and any listed Vendor. Please read these terms carefully before using the Platform.
1. About the Platform
CyberAtlas (“we”, “us”, “our”) operates cyberatlas.com.au (the “Platform”), an online directory that lists cybersecurity service providers operating in Australia (“Vendors”).
The Platform enables organisations and individuals (“Buyers”) to search for and identify cybersecurity Vendors, and enables Vendors to list and promote their services. CyberAtlas does not provide cybersecurity services, advice, assessments, audits, consulting, or any other professional services. We are a publisher and technology intermediary only.
By accessing or using the Platform, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years of age and capable of entering into a legally binding contract to use the Platform. By using the Platform you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
3. Directory Listing Only — No Endorsement or Warranty
3.1 CyberAtlas is a listing and discovery platform. The presence of a Vendor on the Platform does not constitute an endorsement, recommendation, certification, or approval by CyberAtlas of that Vendor, its personnel, its services, its qualifications, or its suitability for any particular purpose.
3.2 We do not verify, audit, or independently assess the accuracy, completeness, currency, or truthfulness of any information submitted by Vendors, including but not limited to claims regarding certifications, accreditations, experience, personnel qualifications, compliance posture, or service capabilities.
3.3 You are solely responsible for conducting your own due diligence when selecting, engaging, and contracting with any Vendor. CyberAtlas strongly recommends that Buyers verify Vendor credentials, request references, obtain independent advice, and review all contractual terms before entering any engagement.
3.4 CyberAtlas is not a party to any contract, agreement, arrangement, or transaction between a Buyer and a Vendor. Any such contract is solely between the Buyer and the Vendor. CyberAtlas has no obligations, liabilities, or responsibilities arising from or in connection with any such contract.
3.5 CyberAtlas does not act as an agent, broker, representative, or intermediary for any Vendor. The routing of a Buyer enquiry to a Vendor does not create any agency relationship between CyberAtlas and that Vendor, or between CyberAtlas and the Buyer.
4. No Professional Advice
Nothing on the Platform constitutes legal, technical, security, compliance, financial, or professional advice of any kind. The Platform provides general directory information only. You should obtain independent professional advice before making any decision based on information found on the Platform.
5. Vendor Obligations
Vendors who create an account, claim a listing, or submit information to the Platform represent and warrant that:
- All information submitted is accurate, complete, current, and not misleading
- They hold all licences, registrations, and qualifications they claim to hold
- Their services comply with all applicable Australian laws and regulations, including consumer protection laws under the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law)
- They will promptly notify CyberAtlas of any material change to information displayed on their listing
- The content they submit does not infringe any third-party intellectual property rights, is not defamatory, and does not violate any applicable law
Vendors indemnify CyberAtlas against any claims, losses, damages, costs, and expenses (including legal fees) arising from or in connection with any breach of these warranties or any act or omission by the Vendor in the provision of its services.
6. Subscription Plans and Billing
Vendors may subscribe to paid listing tiers (“Enhanced” or “Featured”). Subscriptions are billed monthly or annually in Australian dollars (AUD) and are processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis.
- Subscription fees are non-refundable except as required by the Australian Consumer Law or as otherwise stated at the time of purchase
- We reserve the right to change subscription pricing with 30 days' written notice
- You may cancel your subscription at any time through the billing portal; access continues until the end of the current billing period
- We reserve the right to suspend or terminate a listing for breach of these Terms without refund
7. Intellectual Property
All content on the Platform created by CyberAtlas — including but not limited to the Platform design, software, text, graphics, logos, and compilation of listings — is owned by or licensed to CyberAtlas and is protected by Australian and international copyright and intellectual property laws.
Vendors retain ownership of the content they submit but grant CyberAtlas a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Platform and in associated marketing materials for the duration of their listing.
You may not copy, reproduce, scrape, republish, or commercially exploit any content from the Platform without our prior written consent.
8. Prohibited Conduct
You must not:
- Submit false, misleading, or fraudulent information to the Platform
- Impersonate another person or entity
- Use the Platform to send unsolicited commercial communications (spam)
- Attempt to gain unauthorised access to any part of the Platform or its systems
- Use automated tools to scrape, crawl, or harvest data from the Platform
- Engage in any conduct that may damage, overburden, or impair the Platform or interfere with other users' use
- Use the Platform for any unlawful purpose or in a manner that violates any applicable law, including the Australian Consumer Law
9. Limitation of Liability
9.1 To the maximum extent permitted by law, CyberAtlas and its officers, directors, employees, and agents exclude all liability for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising from or in connection with:
- Your use of or inability to use the Platform
- Any reliance on information displayed on the Platform
- Any act, omission, negligence, breach of contract, or misconduct by any Vendor
- The quality, safety, legality, or fitness for purpose of any services provided by a Vendor
- Any transaction, agreement, dispute, or outcome between a Buyer and a Vendor
- Unauthorised access to or alteration of your data
- Any interruption, suspension, or termination of the Platform
9.2 Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition that is implied or imposed by the Australian Consumer Law and cannot be excluded or limited. Where our liability cannot be excluded, it is limited to the maximum extent permitted by law.
9.3 To the extent our liability can be limited, our total aggregate liability to you in connection with the Platform is limited to the greater of (a) the total fees paid by you to CyberAtlas in the 12 months immediately preceding the event giving rise to the claim, or (b) AUD $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless CyberAtlas and its officers, directors, employees, and agents from and against any claims, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:
- Your use of the Platform
- Your breach of these Terms
- Any content you submit to the Platform
- Any dispute between you and another user or third party arising from use of the Platform
- Your violation of any applicable law or third-party rights
11. Third-Party Links and Content
The Platform may contain links to third-party websites, including Vendor websites. These links are provided for convenience only. CyberAtlas does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website. You access third-party sites at your own risk.
12. Platform Availability
We do not warrant that the Platform will be available continuously, error-free, or free from viruses or other harmful components. We reserve the right to suspend, modify, withdraw, or restrict access to the Platform at any time without notice.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms or if required by law. You may terminate your account at any time by contacting us. Termination does not affect any accrued rights or liabilities.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Western Australia, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia.
Before commencing legal proceedings, you agree to contact us at legal@cyberatlas.com.au to attempt to resolve the dispute in good faith within 30 days.
15. Amendments
We reserve the right to amend these Terms at any time. Material changes will be communicated by updating the effective date on this page and, where appropriate, by email to registered users. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be invalid, void, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CyberAtlas with respect to the Platform and supersede all prior agreements, representations, and understandings.
